By accessing or using SmartCemic ("the Platform"), you agree to be bound by these Terms of Use and End User License Agreement ("EULA"). If you do not agree to these terms, do not use the Platform.
NorCemic Inc. ("we", "our", "us") reserves the right to update these terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised terms. We will notify users of material changes via in-app notification or email.
To use SmartCemic, you must meet the following requirements:
You must create an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current information and to keep it up to date.
You may delete your account at any time from the Settings page in SmartCemic. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal and health data.
SmartCemic offers auto-renewable subscription plans. Current subscription plans, features and pricing are published at smartcemic.com/pricing and may change with notice.
Free Trials: If a free trial is offered, it converts to a paid subscription at the end of the trial period unless you cancel before the trial expires. You will be notified before any charge is applied.
The App provides estimated health readings including glucose levels, heart rate, blood oxygen saturation (SpO2), and other biomarkers. These readings are for informational and general wellness purposes only.
QESA device: terms for the QESA device, including any warranty, will be published when the device becomes available.
When using the Platform, you agree not to:
The App and all of its content, features, functionality, design, source code, algorithms, and trademarks are the exclusive property of NorCemic Inc. and are protected by United States and international intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works based on the Platform without prior written consent from NorCemic Inc. "SmartCemic", "QESA", "QESA Pro", "Biomarker Intelligence Device", and the NorCemic logo are trademarks of NorCemic Inc.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NORCEMIC INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.
These terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any dispute arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
