These Terms of Service ("Terms") constitute a legally binding agreement between you and NorCemic Inc. ("Company," "we," "our," or "us") governing your access to and use of the SmartCemic QESA Pro device, mobile application, and related services (collectively, the "Services").

By creating an account, using the device, or accessing any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

To use SmartCemic QESA Pro, you must meet the following requirements:

• Be at least 18 years of age, or 13+ with verified parental consent
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the Services under applicable laws
• Provide accurate and complete registration information
• Reside in a jurisdiction where our Services are available

When creating an account, you agree to:

• Security: Maintain the confidentiality of your account credentials
• Notification: Immediately notify us of any unauthorized access

• Single Account: Maintain only one account per person

Proper use of SmartCemic QESA Pro requires:

• Following all setup and calibration instructions carefully
• Keeping the device clean and properly maintained
• Using only with the official SmartCemic mobile application
• Installing firmware updates when available
• Not attempting to modify, reverse engineer, or tamper with the device

You agree NOT to engage in the following prohibited activities:

• Use the Services for any illegal or unauthorized purpose
• Share your account credentials with others
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Resell, sublicense, or commercially exploit the Services
• Use the device on individuals without their consent
• Reverse engineer or decompile any software

All intellectual property rights in SmartCemic QESA Pro, including patents, trademarks, copyrights, and trade secrets, are owned by NorCemic Inc. or our licensors.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes in accordance with these Terms.

Warranty Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NORCEMIC INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.
